当代中国的社会变迁与女性犯罪

当前我国处于急剧的社会变迁时期,社会变迁带来的社会角色的变迁、社会地位的分化、社会整合力的减弱以及社会流动的加速,是当代女性犯罪不断上升和蔓延的重要原因.本文从社会变迁角度探讨当代女性犯罪的复杂成因.

自然经济和计划经济不可能产生宪政。市场经济是宪政产生和发展的前提和基础。市场经济产生权利观念、权利意识,促进政治法治化、民主化,要求限制政府权力,保护公民权利,产生宪法观念和宪法,培育宪政生存的社会基础———市民社会。     

试论我国刑事附带民事诉讼执行

刑事附带民事案件执行比普通民事执行更难,有其自身特殊的原因。解决刑事附带民事执行难问题已不是执行机构单方面的努力所能解决的,而需要公安机关、人民检察院、监狱和刑事审判庭等各个部门的通力合作。解决刑事附带民事执行难的最终机制在于建立国家补偿制度。     

Estimation of dependence between paired correlated failure times in the presence of covariate measurement error

Summary. In many biomedical studies, covariates are subject to measurement error. Although it is well known that the regression coefficients estimators can be substantially biased if the measurement error is not accommodated, there has been little study of the effect of covariate measurement error on the estimation of the dependence between bivariate failure times. We show that the dependence parameter estimator in the Clayton–Oakes model can be considerably biased if the measurement error in the covariate is not accommodated. In contrast with the typical bias towards the null for marginal regression coefficients, the dependence parameter can be biased in either direction. We introduce a bias reduction technique for the bivariate survival function in copula models while assuming an additive measurement error model and replicated measurement for the covariates, and we study the large and small sample properties of the dependence parameter estimator proposed.

犯罪新闻报道一向是媒体和受众普遍关注的新闻报道类别.它更因与社会稳定、个人生命和财产的安危、法制建设的密切关联而具有重要的社会意义.从春秋时期大臣谋反的罪行记录为发端,沿革历史的推延,中国犯罪新闻报道在报道范围和报道深度上不断地在拓展与加深,逐渐地呈现出自身独有的一些特点.在社会转型的今天,犯罪新闻报道的发展态势更趋迅猛,其形式上日益多样且完善,并呈现出了许多新时期的新特点.     

论被害人陈述的法律地位

被害人在刑事诉讼中所同时具备的当事人角色与实质证人角色之间的冲突，是所有当事人证据都存在的普遍性问题，并不足以否定被害人陈述作为证据的适格性。由于被害人在公诉案件审判程序中并不具备独立的控诉职能，因此相关之角色紧张在一定程度上得以缓和。在我国刑事证据制度构筑封闭式的证据分类体系的情况下，人证及当事人证据在分类逻辑上的要求，决定了被害人陈述不仅是适格的诉讼证据，而且构成独立的法定证据种类。     

Religious affiliation and the family

The process of religious affiliation is mediated by institutions such as the family, which provide a network of ties to the public sphere. Variations in the likelihood of those with no religious affiliation in high school (N=900) becoming church members by the time they reach 30 are explained in terms of a combination of individual attributes, such as educational and spatial mobility, and changes in structural location, such as the transition to marital and parental status. Panel data from the Career Development Study show that women's chances of affiliation are more affected than are men's by parents' religious homogamy, getting married, and having children.

Confidence Intervals for Current Status Data

Abstract.  The likelihood ratio statistic for testing pointwise hypotheses about the survival time distribution in the current status model can be inverted to yield confidence intervals (CIs). One advantage of this procedure is that CIs can be formed without estimating the unknown parameters that figure in the asymptotic distribution of the maximum likelihood estimator (MLE) of the distribution function. We discuss the likelihood ratio-based CIs for the distribution function and the quantile function and compare these intervals to several different intervals based on the MLE. The quantiles of the limiting distribution of the MLE are estimated using various methods including parametric fitting, kernel smoothing and subsampling techniques. Comparisons are carried out both for simulated data and on a data set involving time to immunization against rubella. The comparisons indicate that the likelihood ratio-based intervals are preferable from several perspectives.
